Terms of Service

1. The agreement

These Terms are a legal contract between you (“you”, the account holder) and the operator of DigitalWTN (“we”, “us”). By signing up, you agree to these Terms and to our Privacy Policy and Acceptable Use Policy. If you do not agree, do not use the service.

2. The service

DigitalWTN is a software tool for creating, sharing, and storing digital Waste Transfer Notes (WTNs) that comply with the recordkeeping obligations of the Environmental Protection Act 1990 and the Waste (England and Wales) Regulations 2011.

DigitalWTN does not, today, submit WTNs to the Defra Digital Waste Tracking service. Submission to Defra is a separate forthcoming feature governed by Defra’s own timeline (currently the mandatory date for waste carriers is October 2027). The £26 per annum Defra registration fee is paid by you, directly to Defra, and is never bundled into our pricing.

3. Beta status

At the date of these Terms the service is in open beta. The service is provided free of charge during beta. We may change features, request feedback, and impose rate limits without notice during this period. The service is provided AS IS during beta, without warranty of merchantability or fitness for a particular purpose.

4. Your account

  • You must be at least 18 years old and operating a UK waste-handling business.
  • The role you choose at signup (carrier, receiver, producer) is locked to your account and cannot be changed without our help.
  • You are responsible for the accuracy of the data you submit, including waste classifications, registration identifiers, and signatures.
  • You are responsible for keeping your sign-in credentials secure and for any activity carried out under your account.

5. Pricing

Beta access is free. When we move to a paid plan we will give existing accounts at least 30 days’ notice, by email, with a clear opt-in step. You will never be charged without giving us a payment method first.

6. Acceptable use

See our Acceptable Use Policy for the rules that apply to all accounts. Repeated or material breach can result in account suspension without refund (when paid plans exist).

7. Intellectual property

We retain all rights in the DigitalWTN service, software, branding, and documentation. You retain ownership of any data you upload (WTN payloads, photos, signatures). You grant us a non-exclusive licence to process that data solely to operate the service.

8. Liability

To the maximum extent permitted by law, our aggregate liability to you for any claim arising out of the service is limited to the amount you paid us in the 12 months before the claim arose (which is currently zero, during beta). We are not liable for indirect or consequential losses, including lost profits, lost business, or lost data caused by third-party outages.

Nothing in these Terms limits or excludes liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be limited or excluded.

9. Termination

You may close your account at any time by emailing support@digitalwtn.co.uk. We may suspend or close an account that materially breaches these Terms or the Acceptable Use Policy. On closure we retain WTN records for the statutory recordkeeping period (see the Privacy Policy for detail) and delete the rest within 30 days.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be notified by email at least 14 days before they take effect. Continued use of the service after the effective date means you accept the new Terms.

11. Governing law

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction.
